    OSHA DRAFTS REVISED CITATION POLICY FOR MULTI-EMPLOYER WORKSITES

    OSHA has created a draft policy that would require inspectors to first
    determine whether general contractors at multi-employer worksites have
    overall responsibility for enforcing regulations before the contractors
    could be fined for violations. This revised policy is in response to a
    court decision that challenged the Agency's current policy. Under OSHA's
    existing policy, employers, who have typically been general contractors
    supervising a project, have been cited for violations of other
    contractors or subcontractors. The Agency's revised policy would add new
    measures to OSHA's existing procedures for issuance of citations at
    multi-employer worksites.

    In revising the current policy, OSHA will attempt to define the nature
    of the duty of "reasonable care" a general contractor has over other
    contractors or subcontractors in a multi-employer worksite, according
    to Noah Connell, OSHA's director of construction standards and compliance.
    He pointed out that "the general contractors' responsibilities could be
    determined by analyzing their contractual agreements with subcontractors
    or by examining the nature of their control over subcontractors at the
    site, and if the general contractor controls the site, then the general
