Buyers and new tenants now have the right to know about lead-based
paint in the homes they buy or rent. The new requirements mark the
first phase of a new federal lead program that the EPA and the U.S.
Department of Housing and Urban Development created.The program's
goal is to ensure that families receive basic information on how
to prevent lead exposure before they purchase or rent older housing.
The program's first phase applies to real estate agents and
property owners with more than four residential dwellings, including
single-family homes. It requires them to disclose to purchasers
and new tenants all known lead-based paint hazards in a residence.
It also requires real estate agents and property owners to provide
buyers and new tenants with a pamphlet that contains information
necessary to protect frmilies from lead-based paint hazards before
they close a sale or sign a rental agreement. Property owners also
must provide the same information to tenants now renewing their leases.
Home buyers now have lO days to conduct a lead-based paint inspection
or risk assessment at their own expense before their contracts are final.
The requirements apply to residences built before l978, the year of
the federal ban on the sale of residential lead-based paint.
