2. 노공안전위생법 시행령 (Labor Safety and Health Act Enforcement Rules)
제8조 :
이 시행령에서 지명된 검사 기관 이라는 용어는 동령 제14조 및 15조의 위험
기계류 및 설비류에 대한 지정된 검사(Inspection) 의무를 수행하도록 중앙정부
책임당국으로부터 권한을 받은 행정기관, 학술단체, 공공기업 또는 비영리 단체를
말함.
지정된 검사의무를 수행하는 때에는, 지정된 검사기관은 중앙정부의 책임 당국
의 지시를 받고 검사소관인 담당 당국 및 검사 기관의 감독을 받아야 함.
제14조 :
동령 제8조에서 언급한 위험 기계류 는 다음과 같음 :
1) 고정 크레인
2) 이동 크레인
3) 크랭크 암
4) 엘리베이터
5) 건설용 리프트
6) 공중에 매달려 있는 Cage 및
7) 중앙정부의 책임 당국에 의해 지정된 기타 모든 기기
제15조
동령 제8조에서 언급한 위험설비류 는 다음과 같음 :
1) 보일러
2) 압력용기
3) 고압가스를 사용하는 특수한 기기
4) 고압가스 용기 및
5) 중앙정부의 책임 당국에 의해 지정된 기타 모든 기기
제16조
동령 제8조의 검사 라 함은 기계 및 설비의 범주에 따라 다음과 같이 분류함 :
1) 용접검사
2) 구조검사
3) 종합검사
4) 주기검사
5) Renewal 검사
6) Configuration 검사
7) 운전중 검사 및
8) 개조후 검사

Labor Safety and Health Act
Chapter 2
Safety and health Installations
Article 5
It is the resopnsibility of the employer to provide, necessary
safety and health installations, in conformity with established
standards:
1.To prevent the risk of injury posed by machinery, tools,
equipment, etc.
2.To prevent the risk of injury posed by materials of an
explosive or flammable nature.
3.To prevent the risk of injury posed by electricity, heat, and
other energy sources.
4.To prevent the risk of injury encountered in the course of
quarrying, excavating, loading and unloading, transportation,
stockpiling, and logging;
5.To prevent the risk of injury posed by falls and structure
collapse at the operation area;
6.To prevent the risk of injury posed by high pressure gas;
7.To prevent the risk of injury posed by raw materials,
ingredients, gas, vapors, dust, solvents, chemicals, toxic
substances, oxygendeficient air, biological agents, etc;
8.To prevent the risk of injury posed by radiation, extremes in
temperature, ultrasonic waves, noise, vibration, abnormal
atmospheric pressure, etc;
9.To prevent the risk of injury posed by monitoring
insturuments, and high precision operations;
10.To prevent the risk of injury posed by gas, liquid and solid
wastes; and
11.To prevent the risk of injury posed by floods and fires.
It is the responsibility of the employer to plan for and take
the necessary measures to provide the labor with a safe and
healthy place of employment, including acceptable
passageways, floors, stairways, ventilation, lighting,
illumination, temperature and humidity control, as well as
facilities for rest, emergency exit, first aid, medical treatment,
and other equipment to protect the safety and health of labor.
Standards for the necessary equipment and measures in the
precedng two paragraphs shall be established by the
competent authority of the central government.
Article 6
Employers shall not install machinery, or provide labor with
tools that do not conform to the safety standards established
by the competent authority of the central government.

Article 7
The term "inspection agency" as referred to in the Act shall
mean an agency established by the competent authority of the
central government or by the empowered authority-in-charge
of the provincial (city) or of a specially designated area
government to enforce labor laws and regulation, and to
execute inspection and supervision duties.
Article 8
The term "designated inspection agency" as referred to in the
Act shall mean an administrative agency, academic
organization, public enterprise, or non-profit legal entity
empowered by the competent authority of the central
government to carry out designated inspection duties for the
enforcement of the provisions of Article 14 and Article 15 of
the Act regarding dangerous machinery and equipment.
When conducting the designated inspection duties, the
designated inspection agency shall be directed by the
competent authority of the central government and supervised
by the authority-in-charge and the inspection agency under
whose jurisdiction the designated inspection agency falls.
Article 14
The term "dangerous machinery" as referred to in Article 8
Paragraph 1 of the Act shall include:
1.Fixed cranes,
2.Mobile cranes,
3.Crank arms,
4.Elevators,
5.Construction lifts,
6.Suspension cages, and
7.All other machinery as specified by the competent
authority of th central government.
Elevators referred to in Item 4 of preceding Paragraph
denote only factory elevators or those elevators
provided exclusively for labor use on the site.
Permissible capacity, inspection procedure, inspection
items, inspection standards, and inspection expiration
terms for dangerous machinery referred to in
Paragraph 1 of this Article shall be determined by the
competent authority of the central government.
Article 15
the therm "dangerous equipment" as referred to in
Article 8 Paragraph 1 of the Act shall include:
1.Boilers,
2.Pressure vessels,
3.Specialized equipment for use with high pressure gas,
4.Containers for high pressure gas, and
5.All other equipment as specified by the competent
authority of the central government
Permissible capacity, inspection procedure, inspection
items, inspection standards, and inspection expiration
terms for dangerous equipment referred to in the
preceding Paragraph shall be determined by the
competent authority of the central government.
Article 16
"Inspection" as referred to in article 8 Paragraph 1 of
the Act shall be classified according to the category of
machinery and equipment as follows:
1.Welding inspection,
2.Structure inspection,
3.Conclusion inspection,
4.Periodic inspection,
5.Renewal inspection,
6.Configuration inspection,
7.Operation inspection, and
